Gorsuch, now a justice on the 10th Circuit Court of Appeals, said during Tuesday's hearings Trump had never asked him to overturn Roe v. Wade, the landmark Supreme Court case that legalized abortion nationwide. Responding to the question from Senator Lindsay Graham (R-South Carolina), Gorsuch made it clear that Trump never asked him such a thing. Asked by Democratic Senator Richard Blumenthal of CT whether that included Trump, Gorsuch responded, "anyone means anyone".
As he did Tuesday, Gorsuch also flexed his muscle to say he was an independent judge. "It's not what judges do. The mother described their excruciating decision and the unforgiving process the couple endured to get the medical care they needed".
Sen. Hirono addressed Judge Neal Gorusch at his confirmation hearing Monday in Washington.
The not-so-subtle suggestion is that Democrats are not behaving in good faith, and if they oppose Gorsuch en masse Republicans will be justified in taking extreme measures to get him confirmed - i.e., killing the right to filibuster Supreme Court nominees.
U.S. Sen. Dianne Feinstein (D-Calif.) actually told Gorsuch she was "deeply disappointed that it's under these circumstances that we begin our hearing", making the Senate's failure to consider the Garland nomination sound like a death in the family.More news: Big Dance Free Pick to Click: Wichita St. vs Dayton
For her part, Hirono reviewed the legal opinions of Gorsuch and told him, "I have not seen that the rights of minorities are a priority for you. If I was wrong, Senator, I was wrong because I was bound by circuit precedent, and I'm sorry". Democrats need to be far more concerned about the next vacancy if it's a Democratic appointee, which could tilt the ideological balance on the nation's highest court. "I leave those at home", Gorsuch said in response to a question from Judiciary Committee Chairman Chuck Grassley of Iowa.
Republicans control the Senate and are expected to confirm Gorsuch.
As confirmation hearings for Supreme Court nominee Judge Neil Gorsuch entered their third day Wednesday, Sen. On marriage equality, Trump has sometimes said he'd appoint justices who'd overturn it and other times said it's settled law. All eight justices rejected Gorsuch's approach.
Gorsuch said he has not been asked since his nomination to make promises about future rulings.
This leads to the second point: Democrats are incensed that Barack Obama's pick to fill the vacant seat - Judge Merrick Garland - was denied even a hearing as the Republican leadership gambled on the result of the election.
He is "an outstanding judge", Judge Gorsuch said.
